If
you are considering divorce you may have a number of questions
you would like answered before you see a solicitor.
Q. I have been married for 10 months.
Can I get a divorce?
A. No.
In England and Wales you can’t apply for a divorce
until you’ve been married for at
least one year.
Q. Do I have grounds for a divorce?
A. You
will need to show that the marriage has
“irretrievably broken down.”
Q. How do I show this?
A. One
of the following must be proved:
• Adultery - your
partner has committed adultery.
• Unreasonable behaviour
- your partner’s behaviour is such that
you cannot reasonably be expected to
live with them.
• Desertion -
you have not seen your partner for two years or more.
• Two-year separation with
consent - you have been
separated from your partner for two
years and have their
agreement to apply for a divorce.
• Five-year separation
- you have been separated
from your partner for five years or
more.
The Law Society mentions in one of its many
guides:
“The prospect of divorce action can
be daunting, but the process need not be difficult with the
right professional advice. Your solicitor is there to guide
you through the process, steer you clear of the legal pitfalls
and offer sensitive but independent advice.”
